Learned counsel for the petitioner submits that the petitioner is not running any commercial activity on the subject land, even then a notice has been issued by the Jaipur Development Authority (for short “JDA”) against the petitioner for removal of the commercial activities from the subject land. Learned counsel submits that aggrieved by the aforesaid notice, the petitioner submitted an appeal along-with temporary injunction application before the Appellate Tribunal, JDA. Learned counsel submits that instead of passing interim order in favour of the petitioner, the case has been posted for arguments. Learned counsel submits that looking to the controversy involved in this matter, the petitioner requires interim protection.

Heard and considered the submissions made at the Bar and perused the material available on the record.

Perusal of the record indicates that against the notice dated 23.05.2025 issued by the JDA, the petitioner has already approached the Appellate Tribunal, JDA by way of filing an appeal as well as stay application and the stay application is lying pending for its adjudication on its merits.

In the considered opinion of this Court, the Appellate Tribunal, JDA is expected to decide the stay application expeditiously, preferably on the next date.

In view of above, the writ petition stands disposed of with a direction to the Appellate Tribunal, JDA to decide the stay application on the next date and if not possible on the next date then by posting a short fix date.

Stay application as well as all applications (pending, if any) also stand disposed of.
