Maintenance and Welfare of Parents and Senior Citizens Act, 2007 i.e. to provide effective and legal maintenance and welfare to elderly parents and senior citizens who are unable to support themselves, ensuring their financial security, basic necessities like food, shelter, and medical care, and a life of dignity and respect and that it aims to discourage neglect and abandonment, establish legal recourse for seniors, protect their property rights, and reinforce the societal responsibility of children and relatives to care for their elders, is of the view that in circumstances where the children err to perform their duties, judicial intervention to safeguard the rights and life of the elderly citizens is vital. 8. It is also noted that petitioners, as on date, are living in Udaipur; that the petitioner no. 1 is retired from Armed Forces from which he is drawing pension, withal he is also into occupation at Udaipur; that the respondent has a threat to his life and personal liberty, due to the actions of the petitioners; that the Act of 2007 is sacrosanct statute, for consideration of issues pertaining to the senior citizens (in the matter at hand – respondent, who is aged approximately 80 years of age); that the factual aspect of the matter at hand, the differentiating opinions and conflicts inter-se the parties is already considered in the impugned order dated 11.03.2024; the relevant extract of which is reproduced herein below:
