The matter comes up on an application (IA No.01/2025) filed by the petitioners for taking additional facts and documents on record i.e. order dated 03.02.2025 framing charges and the copies of charges.

By way of this criminal writ petition, the petitioners have assailed order dated 22.10.2024 passed by learned Sessions

Judge, District Dausa in Criminal Appeal No.76/2024, whereby the appeal preferred by the petitioners against the order dated 07.08.2024, passed by learned Presiding Officer, Gram Nyayalaya, Dausa in Criminal Case No.383/2020, taking cognizance for offences under Sections 447, 326 & 307 of I.P.C. against the peitioners, has been dismissed.

Admittedly, after filing of present petition, by order dated 03.02.2025, charges have been framed against the petitioners by the trial court.

In view of subsequent development, learned counsel for the petitioners seeks permission to withdraw this criminal writ petition with liberty to file a fresh petition challenging the order framing charge dated 03.02.2025, which may be treated within limitation. He also seeks liberty to raise the grounds taken in this petition, in the petition challenging the order framing charge.

Accordingly, the criminal writ petition is dismissed as withdrawn, with liberty prayed for. In case, the petitioners file a fresh petition challenging the order dated 03.02.2025 within a period of ten days from today, the application for condonation of delay, shall be considered liberally.
