The instant petitions have been filed under Section 528 of BNSS for quashing the FIR No. 635/2023, registered at Police Station Karni Vihar, District Jaipur City (West) for offences under Sections 143, 323 and 341 of IPC and Sections 3(1)(a) and 3(2) (va) of SC/ST Act, on the basis of compromise entered between the parties.

Learned counsel for Respondent No.2 concedes that the petitioners and respondent No.2 have entered into compromise which bears their signatures vide Annexure-2. It is also contended that this Court verifies the contents of the compromise entered between the parties and the complainant admitted the fact of entering into compromise with the petitioners. The dispute between the parties has already been resolved, therefore, considering the above facts, if the FIR and subsequent proceeding is quashed then the complainant has no objection.

Heard and perused the material available on record. 4. Considering the fact that the parties have agreed upon to enter into compromise and it bears the signature of the complainant and the dispute between the parties is inter-se and does not affect the society at large, this Court placing reliance upon the judgment passed by the Hon’ble Apex Court in Gian Singh Vs. State of Punjab [(2012) 10 SCC 303] and Ramgopal Vs. The State of Madhya Pradesh reported in 2022 (14) SCC 531 , this Court deems it just and proper to allow the present petition.

Considering the aforementioned, the present criminal miscellaneous petitions are allowed on the ground of compromise entered between the parties and the FIR No. 635/2023, registered

at Police Station Karni Vihar, District Jaipur City (West) with all consequential proceedings, are hereby quashed and set aside qua the petitioners.

Accordingly, the instant petitions are allowed.
