By way of filing this petition, a prayer has been made for issuing directions to the respondents for making fair, proper and expeditious investigation in FIR No.246/2023 registered at Police Station Bajaj Nagar, Jaipur City (East) under Sections 420, 406 and 120-B IPC.

On last occasion, this Court directed the Public Prosecutor to furnish factual report of the investigation conducted so far.

Pursuant to the aforesaid order, the factual report has been produced, which indicates that money has been

transferred in certain suspected account and the Police is trying to find out the account holders of the suspected bank accounts, hence delay has occurred.

This Court is not satisfied with the aforesaid explanation submitted by the Investigating Officer by way of the factual report, since the matter pertains to the year 2023.

The investigation cannot be allowed to proceed like a snail’s pace. It is expected from the Investigating Officer to make all possible endeavours to speed up the investigation and submit conclusion report under Section 173 Cr.P.C. before the Competent Court.

If the complainant-petitioner feels aggrieved by any action of the concerned Investigating Officer, then he would be at liberty to move appropriate application under Section 200 Cr.P.C. before the Court concerned to get the status report of the investigation in the light of the judgment passed by the Hon’ble Apex Court in the case of Sakiri Vasu Vs. State Of U.P. And Others reported in 2008 (2) SCC 409 .

In case, any application, as mentioned above, is submitted by the petitioner before the Trial Court, appropriate orders shall be passed by the Court concerned strictly in accordance with law.

With the aforesaid observations, the instant criminal misc. petition stands disposed of. The stay application and all pending applications, if any, also stand disposed of.
