The instant misc. petition has been preferred for quashing of FIR No.251/2015 registered with Police Station Jawahar Nagar, Jaipur.

When the matter was listed before this Court on 21.07.2023, it was apprised by the learned Public Prosecutor on the basis of the factual report received from the concerned Police Station wherein it was indicated that after investigation, the Police took a decision to submit the final report negative, but because of the interim order passed by this Court, final report negative could not be submitted by the concerned Investigating Officer before the competent court of law.

Considering the above factual aspect of the matter, the interim order passed by this Court was modified and the concerned Investigating Officer was directed to submit the FR/result of investigation before the competent court within a period of 15 days.

Since the validity of the impugned FIR is in question under this instant misc. petition which has been resulted in final report negative, hence, under the changed circumstances, this misc. petition has become infructuous.

Dismissed as having become infructuous.

Stay application as well as all pending applications, if any, also stand dismissed.

¶24

However, the petitioner would be at liberty to move an application for revival of this misc. petition. In case, final report negative has not submitted before the competent court and still and in case, the Police is still investigating the matter.
