After arguing to some extent, learned counsel for the petitioner seeks withdrawal of the instant misc. petition but at the same time implores for issuance of certain directions to the learned trial Court so that he may be able to make a plea for discharge and the same can be considered appropriately.

The prayer seems to be genuine.

Accordingly, the misc. petitions are disposed of.

The petitioner would raise a plea of discharge before the learned trial Court on the grounds raised by him in the instant petition amongst others. In such event, the learned trial Court shall here it, consider his submissions coupled with the facts and circumstances of the case and then would pass a reasoned and speaking order as per the mandate contained under Sections 239 and 240 of the Cr.P.C. The order must reflect consideration of the submission made at the instance of the parties.

Observing that the petitioner is an octogenarian and suffering from certain ailments, the learned trial court is directed to exempt him from personal appearance, allowing him to attend the court proceedings through his pleader. Unless in unavoidable circumstances, he shall not be compelled to remain present in Court.

The stay petitions also stand disposed of.
