The instant petition has been preferred against the order dated 14.10.2022, whereby the application of the petitioner for converting the arrest warrants into bailable warrants under Section 70(2) of the Cr.P.C. was dismissed.

It is contended by learned counsel for the petitioners that the order of dismissal of converting arrest warrants into bailable warrants passed by Learned Trail Court was challenged by the petitioners before the Revisional Court and the Revisional Court dismissed the revision petition of the petitioners assigning it to be not maintainable, as it was against an interlocutory order. It is also contended by learned counsel for the petitioners that due to inadvertent condition and pandemic of Covid-19, petitioners could not mark their presence before the concerned trial court on 10.02.2021. Petitioners are ready and willing to appear before the trial court and face the trial, therefore, instant petition for converting their arrest warrants into bailable warrants may be allowed.

On the other hand, learned Public Prosecutor submitted that petitioners remained absent on 10.02.2021, thereafter they remained absent for almost one year and did not appear before the concerned trial court. Trial has been delayed due to absence of petitioners, the impugned order was passed in the year 2022 and still petitioners have not appeared before the trial court.

Heard and perused the material available on the record.

This court do not find any cogent reason to entertain the present petition. The order passed by learned Trial court also shows that petitioners after issuance of the arrest warrants have never made attempt to appear before the concerned court. The petition is pending since 2022 and it can be presumed that the trial court must have issued several arrest warrants against the petitioners, however the petitioners did not appear before the concerned trial court.

Considering the above facts, this court is not inclined to grant any relief to the petitioners. However, learned trial Court is directed to consider the petitioners bail application with sympathy if the petitioners appear before the court within a time period of 15 days.

Accordingly, the instant criminal misc. petition stands disposed of.
