The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 156/2025 registered at Police Station Kundera, District Sawai Madhopur (Raj.) for the offence(s) under Sections 318(4), 319(2), 336(3), 338, 340(2) of BNS, 2023 and Section 66-D of I.T. Act and Section 13 of R.P.G.O. Act.

Learned counsel for the applicant has submitted that applicant is a young boy aged approximately 19 years and is in custody ever-since 15.07.2025. It is submitted that the chargesheet has been filed. It is submitted that complaint is filed by not the effected party but the police authorities.

Learned amicus curiae as well as learned counsel for the State have submitted that the matter pertains to cyber crime. It is submitted that the area from which the applicant is domicile of, is commonly related to the persons involved in commission of offences of cyber crime in India. It is submitted that different bank accounts were used malafidely, and prima facie allegations are qua involvement of the applicant in commission of cyber crime.

Considering the overall facts, taking note of the fact that the applicant is a young man, who is at fag end of his teen age; that the applicant has been in custody since 15.07.2025; that chargesheet has been filed, however, without commenting upon the merits/demerits of the case, this Court is inclined to allow the present bail application and enlarge the accused-applicant on bail subject to following conditions:

4.1 That the applicant will render all the details the bank accounts which are operated under his name, to the Investigating Authorities, so that appropriate investigation is carried out.

4.2 During the currency of trial, the applicant shall only operate and use one account, for his regular personal lawful purposes.

¶22

4.3 Applicant shall only use the SIM card that is linked and registered with the AADHAR authorities; and in any possibility shall not make an attempt to commit or indulge in any unlawful activity, while using the mobile phone. If the applicant has an additional number that is operated by him or is issued under his name and the same is not registered with the AADHAR authorities, the same shall be surrendered at the Police Station concerned, during the pendency of trail.

4.4 Applicant will render all appropriate cooperation to the police authorities and mark attendance before the police authorities concerned on 5^th of successive month, upon release.

4.5 It is submitted that during the continuation of the present matter and trial, applicant will be restrained from use of any social media application, illustratively apps like telegram and whatsApp.

4.6 Surety as directed herein below shall be given by a member of family/ blood relative of the applicant.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that accused-applicant Manraj @ Pintu S/o Late Hanuman shall be enlarged on bail provided he furnishes a personal bond of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of learned trial Judge for his appearance before the court concerned on all the dates of hearing as and when called upon to do so.
