Instant application for bail filed under Section 483 of BNSS by the applicant-accused Peyush Bhardwaj S/o Ramesh Chand in FIR No. 44/2025 dated 18.02.2025 registered at P.S. Baggar, District -Jhunjhunu, whereby the applicantaccused was charged under Sections 420, 406, 409 and 120B IPC.

The applicant was arrested and is in judicial custody since his arrest. The Court below has dismissed the bail application.

Learned counsel for the applicant relying upon grounds raised in bail application submits that the applicant is innocent and falsely implicated in the present case. He further submits that this applicant was working as Village Development Officer and his duty was to follow instruction

and command of Sarpanch. He further submits that Sarpanch Nachi Devi was granted bail by a Coordinate Bench of this Court on 09.06.2025. He further submits that offence for which this applicant is charged is triable by Magistrate Ist Class and the applicant-accused has not committed criminal breach of trust.

Aforesaid contentions were opposed by learned Public Prosecutor.

Heard learned learned counsel for applicant and learned Public Prosecutor. Perused the material placed on record.

On basis of complaint lodged by Development Officer Panchayat Samiti, Jhunjhunu on 18.02.2025 about payment of more than ₹90,00,000/- to unauthorized person and nonfiling of reply by present applicant-accused, who was working as Village Development Officer, a report is registered and matter is investigated. It also mentioned that the payment is made only from joint signatures of Sarpanch and Secretary and both are jointly liable.

Sarpanch Nachi Devi was granted bail by a Vacation Bench of this Court on 09.06.2025 on the ground that she was a lady and having the minor kid. Present applicant is a regular employee and drawing salary from exchequer, therefore, he is more liable than a temporary public representative like Nachi Devi.

The record further indicate that FIR No.34/2025 was registered at P.S. Sadar, Jhunjhunu on 15.02.2025 against present applicant-accused for irregular payment of ₹1.28 crore while he was working as Village Development Officer at

Village Panchayat, Udawas. Similarly, FIR No.45/2025 was registered at P.S. Baggar on 18.02.2025 for unauthorized payment of rupees more than 23 lacs by present applicant when he was working as Village Development Officer at Village Panchayat, Pratappura. Present case is related to Village Panchayat, Indali when present applicant was working as Village Development Officer.

Aforementioned record clearly indicate that present applicant-accused is in habit to conspire when Sarpanch or other persons to indulge in corrupt and malpractices and dishonestly misappropriating Government money to own use or for converting in violation legal obligation.

This is a case of serious nature and in case like present one, applicant-accuses is not entitled to be released on bail.

In view of discussion made hereinabove, the instant bail application under Section 483 of BNSS preferred by applicant-accused Peyush Bhardwaj S/o Ramesh Chand , is hereby dismissed.
