This instant application for bail filed under Section 483 of BNSS by the applicant-accused Mangal Singh @ Mangat Singh @ Mangu Son Of Shri Chimman Singh in FIR No. 244/2025 dated 10.06.2025 registered at P.S. Ramgarh (Alwar) District -Alwar, whereby the applicant-accused has charged under Sections 16/54 of Rajasthan Excise Act, 1950.

The applicant was arrested and is in judicial custody since his arrest. The Court below has dismissed the bail application.

Learned counsel for the applicant relying upon grounds raised in bail application submits that the applicant is innocent and falsely implicated in the present case. He further submits that two FIRs No. 244/2025 and 254/2025 were registered on false and fabricated facts against the applicant and the facts clearly indicate that applicant-

accused was not found at the place of incident but he was arrested in both the cases on one day and falsely implicated by police. He further submits that criminal case arising out of FIR No. 157/13 has been disposed of whereas another case FIR No. 510/2024 is again a false case where no recovery was effected from appellant-accused. Further, he submits that the investigation relating to present applicant-accused is complete and he is no more required by the Investigating Agency for investigation. He further assures that in case, the applicant-accused is required for further investigation, the applicant-accused will be available for such investigation. He also submits that the investigation/trial will take its own time and no purpose will be served by keeping the applicantaccused in custody.

Aforesaid contentions were opposed by learned Public Prosecutor.

Heard learned counsel for the applicant-accused and learned Public Prosecutor.

As per facts of the case, appellant-accused run away when police has search and raided the crime scene and he was arrested on later occasion. The record also indicate that matter arising out of FIR No. 157/13 was disposed of on 08.10.2016 whereas charge-sheet has been filed in a matter arising out of FIR No. 510/2024 but this accused is not arrested in a matter arising out of FIR No. 254/2025.

Upon hearing the arguments and perusing the record, we have found that the applicant-accused is no more required in the investigation and he is in custody for quite some time.

The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicantaccused.

Thus, the instant bail application filed on behalf of applicantaccused Mangal Singh @ Mangat Singh @ Mangu Son Of

Shri Chimman Singh , is hereby allowed and the applicantaccused is ordered to be released on bail upon furnishing a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-

(i) The applicant-accused shall not tamper with evidence or influence the witness in any manner.

(ii) The applicant-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

(iii) The applicant-accused shall mark his attendance on every first Monday of every month at concerned Police Station till disposal of the sessions case.

(iv) The applicant-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court.
