The present bail application has been filed by the accusedapplicant under Section 483 of the B.N.S.S, 2023 against the order dated 18.06.2025 passed by learned Additional District and Sessions Judge No.4, Kotputli, District Kotputli-Behror in connection with FIR No. 226/2024, registered at Police Station Bhabru, District Kotputli-Behror for the offences punishable under Sections 281, 125(a) & 106(1) of BNS, 2023, by which the bail application of the accused-applicant under Section 483 of the B.N.S.S, 2023 has been dismissed.

Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this matter. Learned counsel argues that initially a case under Sections 281, 125(a) & 106(1) of BNS was registered. Learned counsel also

argues that the allegation against the accused-applicant is that he was driving the vehicle ECO Van bearing registration No.HR26EK4498 in a rash and negligent manner and dashed against one Vijay Kumar and Smt. Babli Devi, in which Vijay Kumar died and Babli Devi got injured. Learned counsel contends that later on during the investigation, offence under Section 105 of BNS has been added for committing culpable homicide not amounting to murder. Learned counsel further contends that the accused-applicant had no intention to kill anybody and the incident occurred all of sudden. It is further submitted that the accused-applicant is serving in Indian Army. Learned counsel also submits that the incident had occurred on 08.12.2024 and the investigation is still pending. Learned counsel further submits that the accused-applicant was arrested on 02.06.2025 and since then, he is behind the bars. Learned counsel prays that the investigation and trial will take long time to conclude, therefore, the accusedapplicant be enlarged on bail.

On the other hand, learned Public Prosecutor opposes the bail application. 4. Heard learned counsel for the parties and also perused the material available on record.

Having regard to the facts and circumstances of the case and considering the facts that the accused-applicant is behind the bars since 02.06.2025; that the investigation and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicant.

Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicant Sachin @ Sonu Singh S/o Gokul Singh , arrested in FIR No. 226/2024, registered at Police Station Bhabru, District KotputliBehror shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the learned trial Court.

The Accused-Applicant shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
