The present bail application has been filed by the accusedapplicants under Section 483 of the B.N.S.S, 2023 against the order dated 13.06.2025 passed by learned Additional District and Sessions Judge No. 2, Kota in connection with FIR No. 144/2025, registered at Police Station Dadabari, District Kota City for the offences punishable under Sections 333, 351(3), 352, 189(2) and 61(2) of BNS, 2023, by which the bail application of the accusedapplicants under Section 483 of the B.N.S.S, 2023 has been dismissed.

Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this matter. Learned counsel argues that the FIR against the accusedapplicants has been lodged for the offences punishable under Sections 333, 351(3), 352, 189(2) and 61(2) of BNS and all the charges levelled against the accused-applicants are triable by Judicial Magistrate. Learned counsel also argues that the accusedapplicants were arrested on 07.06.2025 and since then, they are behind the bars. Learned counsel contends that the complainantArvind Choudhary and accused-applicants have compounded the offence, for which affidavit of the complainant-Arvind Choudhary has been submitted, in which, complainant has stated that he does not want any action in the FIR lodged by him, therefore, looking to the facts and circumstances of the case and the factum of compromise arrived at between the parties the accusedapplicants be enlarged on bail.

On the other hand, learned Public Prosecutor opposes the bail application.

Mr. B.K. Sharma, learned counsel appears on behalf of the complainant, has admitted the factum of compromise arrived at between the parties.

Heard learned counsel for the parties and also perused the material available on record. 6. Having regard to the facts and circumstances of the case and considering the facts that the accused-applicants are behind the bars since 07.06.2025; that the charges levelled against the accused-applicants are triable by Judicial Magistrate and also the fact that the parties have arrived at compromise, but without

expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicants.

Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicants namely; (1) Ajay Prajapati S/o Ramesh Chand & (2) Ravi @ Rajendra Singh S/o Shambhu Singh , arrested in FIR No. 144/2025, registered at Police Station Dadabari, District Kota City shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.50,000/- and two solvent sureties of Rs.25,000/- each to the satisfaction of the learned trial Court. 8. The Accused-Applicants shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
