The present bail application has been filed by the accusedapplicants under Section 483 of the B.N.S.S, 2023 against the order dated 25.04.2025 passed by learned Additional Sessions Judge No-01, Kishangarh, District Ajmer (Raj.) in connection with FIR No. 09/2025, registered at Police Station Madanganj, District Ajmer for the offences punishable under Sections 189(2), 115(2), 126(2) & 303(2) of BNS, 2023, by which the bail application of the accused-applicants under Section 483 of the B.N.S.S, 2023 has been dismissed.

Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this matter. Learned counsel argues that the charge-sheet against the accused-applicants have been filed for the offences punishable under Sections 189(2), 115(2), 126(2), 118(1), 110, 190 & 191(2) of BNS. Learned counsel also argues that the accusedapplicants were arrested on 15.04.2025 and since then, they are behind the bars. Learned counsel contends that the injuredAakash and Manish have compounded the offence with the accused-applicants and compromise has been submitted before the learned Trial Court. Learned counsel further contends that on the basis of compromise co-accused-Lokesh has been enlarged on bail by learned Trial Court, therefore, on the basis of compromise between the parties the present accused-applicants be enlarged on bail.

On the other hand, learned Public Prosecutor opposes the bail application.

Mr. Pawan Sharma, learned counsel appears on behalf of the injured-Aakash and Manish, has admitted the factum of compromise arrived at between the parties and submits that injured/complainant have no objection if the accused-applicants have been enlarged on bail.

Heard learned counsel for the parties and also perused the material available on record.

Having regard to the overall facts and circumstances of the case and considering the facts that the accused-applicants are behind the bars since 15.04.2025; that all the injuries suffered by the injured persons have been found simple in nature; that the

charge-sheet has been filed and also the fact that the parties have arrived at compromise, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicants.

Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accused-applicants namely; (1) Prakash Mahala Alias Lala S/o Shri Ramgopal

Mahala & (2) Ramsawroop Jat Alias Bhura S/o Shri Motiram , arrested in FIR No. 09/2025, registered at Police Station Madanganj, District Ajmer shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.50,000/- and two solvent sureties of Rs.25,000/- each to the satisfaction of the learned trial Court.

The Accused-Applicants shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
