The accused-petitioner has filed this second bail application under Section 483 B.N.S.S. arising out of F.I.R. No.423/2023 registered with the Police Station Neem Ka Thana (Sikar), District Neem Ka Thana for offence under Sections 302 IPC.

The first bail application of the accused-petitioner was dismissed as withdrawn vide order dated 02.07.2024.

The Court vide order dated 05.08.2025 summoned the report from the learned trial Court as regard the status of the trial of the case.

The learned Additional District and Sessions Judge No.1, Neem Ka Thana, District Sikar (Raj.) vide letter dated 14.08.2025 has sent the status report of the case.

As per the report of the learned trial Court, only witnesses Nos.3, 9 & 13 are remaining to be examined for which bailable warrants were issued for 21.08.2025. As per the report, after examination of nine witnesses, accused petitioner changed the lawyer and the new lawyer filed the Vakalatnama on 19.04.2025 and, thereafter, on the request of the accused side, opportunity to cross examine the witness Anoop Singh (PW10) was allowed and he was examined on 17.07.2025.

Having considered the report, the Court is of the opinion that the trial of the case is at fag end, hence, this Court is not inclined to enlarge the accused-petitioner on bail at this stage.

Accordingly, the present second bail application is dismissed.

However, looking to the custody period of the accusedpetitioner, the learned trial Court is expected to conclude the trial of the case as early as possible.
