The present bail application has been filed by the accusedapplicant under Section 483 of the B.N.S.S., 2023 against the order dated 03.01.2025 passed by learned Additional Sessions Judge No.1, Kishangarh, District Ajmer in Bail Application No.3/2025 arising out of FIR No.95/2024, registered at Police Station Bandar Sikri, District Ajmer for the offences punishable under Section 191(2), 191(3), 190, 109(1) and 329(3) of B.N.S., 2023 and Sections 3/25 and 3/27 of Arms Act, 1959 by which the bail application of the accused-applicant under Section 483 of the B.N.S.S., 2023 has been dismissed.

Learned counsel for the accused-applicant submits that the accused-applicant has falsely been implicated in this case. Learned counsel also submits that as per the prosecution case, large number of people were present on the scene of incident. Learned counsel contends that since 25.07.2024, the accusedapplicant is behind the bars and trial against the accused-applicant will take long time to conclude. Learned counsel further contends that there is a land dispute between the parties. Learned counsel also contends that there is no other criminal case registered against the accused-applicant, therefore, the accused-applicant be enlarged on bail.

On the other hand, learned counsel appearing on behalf of the State and learned counsel for the complainant while vehemently opposing this bail application submit that as per the medical opinion, gun-shot injuries caused to the injured have been found to be dangerous to life and the charges levelled against the accused-applicant are grievous in nature. Learned counsel for the complainant submits that the fact that the accused-applicant has no criminal antecedents, cannot be the only ground to grant the benefit of bail.

In support of his contentions, learned counsel for the complainant draws attention of this Court towards the judgment passed by the Hon'ble Apex Court in the case of Tarun Kumar Vs. Assistant Director, Directorate of Enforcement reported in 2023 INSC 1006 .

Heard learned counsel for the parties and also perused the material available on record.

Considering the overall facts and circumstances of the case; looking to the period of custody of the accused-applicant; that the charge-sheet has already been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the applicant.

Consequently, this bail application filed under Section 483 of the B.N.S.S., 2023 is allowed. It is ordered that accused-applicant Dinesh Singh S/o Late Shri Ishwar Singh, arrested in connection with FIR No.95/2024, registered at Police Station Bandar Sikri, District Ajmer shall be released on bail; provided he furnishes personal bond in the sum of Rs.1,00,000/- and two solvent attested sureties of Rs.50,000/- each to the satisfaction of the trial Court. Applicant will be required to appear before that Court on all dates of hearing and as and when called upon to do so.
