The petitioner has preferred this bail application under Section 483 of BNSS in FIR No.145/2024 registered at Police Station-Senthal, District-Dausa for the offences under Sections 109(1), 115(2), 126(2), 324(5), 324(6), 303(2) & 131 of BNS, 2023 & 3, 25 & 25(6) of Arms Act.

Heard learned counsel for the petitioner, learned Public Prosecutor as well as counsel for the complainant and perused the material available on record.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in this case. He further submits that no specific act was attributed to the petitioner and the complainant-Sardar Singh and the petitioner have arrived at compromise supporting which, an affidavit has been filed. He

again submits that there is no medical opinion by which it can be inferred that the so called injuries are dangerous to life. He further submits that the petitioner is behind the Bars since 09.02.2025 and charge-sheet has been filed, hence no fruitful purpose would be served by keeping the present petitioner in further custody. The trial of the case may take considerable time, hence the bail application of the petitioner may be allowed.

Learned Public Prosecutor and counsel for the complainant have vehemently opposed the bail application.

Learned counsel for the complainant has consented the argument advanced by learned counsel for the petitioner and verified the fact that the petitioner and complainant have arrived at compromise.

On the contrary, learned Public Prosecutor has controverted the arguments advanced by both the parties and stated that looking to the gravity of the offence, the bail application is liable to be dismissed.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, especially the affidavit filed by the complainant-injured-Sardar Singh and the fact that there is no medical opinion but without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioner.

Accordingly, the bail application under Section 483 B.N.S.S. is allowed and it is ordered that the petitioner -Bittu @ Ravindra @ Rajendra S/o Babulal shall be released on bail on his furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial court for his appearance before that Court on all the dates till conclusion of the trial.
