The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.622/2017 registered at Police Station Kherli, District Alwar for the offence punishable under Section 379 of IPC. After completion of investigation, police filed charge-sheet in this matter.

Learned counsel for the petitioner submits that petitioner has falsely been implicated in this case. It is submitted that petitioner was granted bail but on account of some unavoidable circumstances, he could not appear before learned trial court in the year 2018 therefore, his bail bonds were forfeited and his presence was secured by issuing warrant of arrest. Counsel submits that in pursuance of a warrant of arrest, petitioner was arrested on 06.01.2025 and produced before the Court wherein

his bail application was dismissed vide order dated 09.01.2025. Learned counsel contends that alleged offence is triable by Magistrate for which maximum term of sentence is three years and petitioner has already served incarceration of about 8 months. It is contended that there is bleak chance of culmination of trial in near future and no fruitful purpose would be served by keeping the petitioner behind the bars.

Learned Public Prosecutor opposes the submissions made by counsel for the petitioner. He submits that after jumping the bail, petitioner remained absconded for a period of seven years and during this period, he committed 12 offences.

I have considered the contentions.

Having regard to the facts and circumstances of the case and considering the arguments advanced by both the parties; as also considering the fact that after jumping the bail, petitioner committed 12 offences, this Court is not inclined to enlarge the petitioner on bail.

Accordingly, this bail application is dismissed.

Learned trial court is directed to expedite the proceedings and shall conclude the same preferably within a period of six months from the date of receipt of certified copy of this order.
