This second bail application has been filed by the accused petitioner u/S 483 BNSS in connection with FIR No. 85/2024 registered at Police Station Sarmathura, District Dholpur for offences u/S 332, 353, 307 of IPC and Section 3, 25 of Arms Act and Section 3 of PDPP Act.

The first bail application bearing No. 5567/2024 filed by the accused petitioner was dismissed vide order dated 18.07.2024.

PW-2 Narsi Ram in his cross examination has specifically stated that no injury was caused to any of the police personnel by the fire arm used by the accused petitioner.

Learned counsel for the accused petitioner also submitted that out of total 20 prosecution witnesses, only four has been

examined so far and the accused petitioner is in custody since 23.03.2024.

Taking into consideration the allegations levelled against the accused petitioner so also the material fact that as per the statements of the prosecution witness PW-2, who has been examined before the trial Court, no injury has been sustained by the complainant party by use of fire arm by the accused petitioner and he is in custody since 23.03.2024 and only four prosecution witness have been examined so far, this Court without expressing any opinion on merits or demerits of the case, deems just and proper to enlarge the petitioner on bail.

Accordingly, this second bail application is allowed and it is directed that accused-petitioner shall be released on bail provided that he furnishes a personal bond in the sum of Rs. 1,00,000/(Rupees One Lac Only), together with two sureties in the sum of Rs. 50,000/- (Rupees Fifty Thousand Only) to the satisfaction of the Trial Court with the stipulation that he shall appear before that Court or any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
