The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioners. The petitioners have been arrested in connection with FIR No.06/2025 registered at Police Station Nahargarh (Baran), District Baran for the offence(s) under Sections 189(2), 115(2), 126(2), 109(1) and 352 of BNS.

Learned counsel for the accused-petitioner No.1 Deepu S/o Hariram, does not want to press the present criminal misc. bail application and seeks liberty to file afresh after filing of the charge-sheet.

Learned counsel for the accused-petitioner Nos.2 and 3 submits that the accused-petitioners have falsely been implicated in this case. He further submits that the main allegation of causing injuries to injured Ramprasad and Mahaveer are against other coaccused Golu, Dheeraj and Deepu and not against the present petitioners. The accused-petitioners are in custody since 04.03.2025, and trial/investigation of the case may take considerable time, therefore, the bail application of the accusedpetitioners may be allowed.

Learned Public Prosecutor as well as learned counsel for the complainant have vehemently opposed the bail application and contended that the accused-petitioners along with the other coaccused caused injuries to injured Ramprasad and Mahaveer, as a result of attack, Ramprasad sustained grievous injury at his head resulting into fracture of frontal bone on right side with extension into right frontal sinus and base of anterior cranial fossa. The injuries sustained to other injured Mahaveer are also at vital part, therefore, the bail application of the accused-petitioners may be dismissed.

Heard and perused the material available on record.

It is not desirable to express anything on the merits of the case. The specific allegations of causing injuries to injured Ramprasad and Mahaveer are attributed to petitioner No.1 Deepu and other co-accused Golu and Dheeraj, therefore, considering the above facts, I deem it just and proper to enlarge the accusedpetitioner Nos.2 and 3 on bail.

Accordingly, the bail application of the accused-petitioner Nos.2 and 3 under Section 483 BNSS is allowed and it is ordered that the accused-petitioners namely: 2. Sonu S/o Hari Singh and 3. Surendra S/o Mohan Lal, in connection with FIR No.06/2025 registered at Police Station Nahargarh (Baran), District Baran shall be enlarged on bail provided both of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.

The bail application of the accused-petitioner No.1 Deepu S/o Hariram is dismissed as not pressed with liberty to file afresh after filing of the charge-sheet.
