The present bail application has been filed under Section 483 B.N.S.S. in connection with FIR No.564/2018 Registered at Police Station Jhotwara, Jaipur (West) for the offence(s) under Sections 420, 406, 467, 468, 471 and 120-B IPC.

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 12.10.2021. Charge-sheet has been filed against the petitioner. Learned counsel for the petitioner further submits that the petitioner was convicted for the offence under Section 138 of N.I. Act. Offence against the petitioner is triable by the Magistrate. Conclusion of trial may take long time. So, the petitioner be enlarged on bail.

Learned Dy.G.A. as well as learned counsel for the complainant have opposed the arguments advanced by learned counsel for the petitioner and submitted that earlier, petitioner was enlarged on bail by this court vide order dated 10.12.2018 on the basis of compromise, according to which, the petitioner agreed to return entire amount to the complainant within six months. While enlarging the petitioner on bail, this court had ordered that if the petitioner fails to honor the compromise, the complainant would be at liberty to seek cancellation of bail granted to the petitioner. Since the compromise was not honored, this court vide order dated 05.02.2020 cancelled the bail granted to the petitioner. The petitioner had challenged the said order before the Hon’ble Apex Court by way of filing SLP which was withdrawn by him. They further submit that the petitioner had not honored the compromise, so this court vide order dated 26.03.2021 dismissed the second bail application filed by the petitioner. After that, till today petitioner has not tried to honor the compromise. They further submit that 22 cases of similar nature are also pending against the petitioner. Petitioner is a habitual offender. So, looking to the gravity of offence, the 6^th bail application filed by the petitioner be dismissed.

I have considered the arguments advanced by learned counsel for the petitioner, learned counsel for the complainant as well as learned Dy.G.A.. 5. It is an admitted position that this court had granted bail on the basis of undertaking given by the petitioner that he would return the entire amount to the complainant within a period of six months but the petitioner failed to honor the compromise. So, this

court vide order dated 05.02.2020 cancelled the bail granted to the petitioner. Till today, petitioner is not ready to honor the compromise. There are 22 cases of similar nature are also pending against the petitioner. So, looking to the gravity of offence and nature of allegation, I do not consider it a fit case to enlarge the petitioner on bail.

Consequently, this Criminal Miscellaneous 6^th Bail Application is dismissed.
