The instant bail application has been filed under Section 483 BNSS on behalf of accused-petitioner. The petitioner has been arrested in connection with FIR No. 79/2025 registered at Police Station Shiprapath, District Jaipur City (South) for the offence(s) under Section 8/20 of the NDPS Act.

Learned counsel for the petitioner submits that the accusedpetitioner has falsely been implicated in this case. It is contended that the recovered quantity of contraband articles containing ganja is 10.340KG, which is below commercial quantity. The accused-petitioner is in custody since 03.02.2025 and the trial/investigation of the case will take considerable time. There are no criminal antecedents against the petitioner. enlarged on bail vide order dated 25.02.2025, therefore, the benefit of grant of bail may be granted to the accused-petitioner.

Per contra, learned Public Prosecutor opposes the grant of bail application.

Considering the arguments advanced by the counsel for the parties and looking to the fact that accused-petitioner is in custody since 03.02.2025 and the trial/investigation of the case will take considerable time. There are no criminal antecedents against the petitioner and similarly situated co-accused has already been enlarged on bail, without commenting anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 BNSS is allowed and it is ordered that the accused-petitioner Balram Mahnta S/o Beerendra Nath, in connection with FIR No. 79/2025 registered at Police Station Shiprapath, District Jaipur City (South) shall be enlarged on bail provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for her appearance before the court concerned on all the dates of hearing as and when called upon to do so.
