The accused-petitioner has filed this third bail application under Section 483 B.N.S.S. arising out of F.I.R. No.130/2024 registered with the Police Station Bajaj Nagar, District Jaipur City (East) for offence under Sections 420, 406 & 120-B IPC.

The first bail application bearing No.6343/2024 was dismissed as withdrawn by this Court vide order dated 10.07.2024 with liberty to file fresh bail application after completion of investigation. The second bail application bearing No.10474/2024 was dismissed by this Court vide order dated 09.09.2024 with liberty to file fresh bail application after examination of the complainant-witness by the learned trial Court.

Learned counsel for the accused-petitioner submits that charge has been framed against the accused-petitioner on 07.10.2024. When the case was listed for examination of the prosecution witnesses on 04.11.2024, the complainant witness sought time to produce certain documents and time was allowed. Counsel further submits that after 04.11.2024 till date, no document has been submitted by the complainant-witness and till date no statement of any single witness has been recorded by the learned trial Court. Counsel also submits that the petitioner is in custody for last about one year i.e. since 24.04.2024 and trial of the case will take considerable time to conclude, therefore, he may be released on bail.

Learned Public Prosecutor has opposed the prayer and submissions made by learned counsel for the accused-petitioner.

Considered the submissions made at bar so also perused the material made available on record.

Having considered the submissions made by learned counsel for the accused-petitioner, more particularly the fact that even the examination of single prosecution witness is not complete so far and the complainant sought time to produce certain documents and even after passing of three to four months, he has not submitted any document in evidence, this Court feels that the complainant is delaying the trial and therefore, this Court without expressing any opinion on the merits and demerits of the case, deems just and proper to enlarge the accused-petitioner on bail.

This third bail application is, accordingly, allowed and it is directed that accused-petitioner shall be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/(Rupees One Lac only) together with two sureties in the sum of Rs.50,000/- (Rupees Fifty Thousand only) each to the satisfaction of the trial Court with the stipulation that he shall appear before that Court or any other Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
