The present 7^th bail application has been filed under Section 483 B.N.S.S. in connection with FIR No.47/2021 Registered at Police Station Sodala, Jaipur City (South) for the offence(s) under Section 302 IPC (later on offence under Sections 302, 460, 380 and 34 IPC were found to have been made out).

Learned counsel for the petitioner submits that the petitioner has been falsely implicated in this case. He is behind the bars since 28.01.2021. Learned counsel for the petitioner further submits that co-accused Surendra Singh from whom recovery was made, has been enlarged on bail by the Co-ordinate Bench of this Court vide order dated 16.01.2023 in S. B. Criminal Miscellaneous 2^nd Bail Application No.14659/2022. Learned counsel for the petitioner further submits that evidence of recovery witnesses is not truthful because there are major contradictions in their

evidence. Conclusion of trial may take long time. So, the petitioner be enlarged on bail.

Learned Public Prosecutor has opposed the arguments advanced by learned counsel for the petitioner and submitted that prosecution evidence has been completed and the matter has been posted for recording the statement of accused under Section 313 Cr.P.C. and trial is going to be concluded very soon. So, at this stage, the petitioner should not be enlarged on bail. So, the 7^th bail application filed by the petitioner be dismissed.

I have considered the arguments advanced by learned counsel for the petitioner as well as learned Public Prosecutor. 5. It is an admitted position that the previous bail applications filed by the petitioner have been dismissed on account of gravity of offence. Prosecution evidence has been completed in the present case and the matter has been posted for recording the statement of accused under Section 313 Cr.P.C. So, in my considered opinion, when the trial is likely to be concluded very soon, no ground is made out to enlarge the petitioner on bail.

Consequently, this criminal miscellaneous 7^th bail application filed by the petitioner is dismissed.
