These instant bail applications have been filed under Section 483 BNSS on behalf of accused-petitioners. The accusedpetitioners have been arrested in connection with FIR No. 39/2025 registered at Police Station Pahari, District Deeg for the offences under Sections 319(2), 318(4), 338, 336(3), 340(2), 308(2), 111(6) and 61(2)(b) of BNS and Section 66D of IT Act.

Learned counsel for the accused-petitioners submits that the accused-petitioners have falsely been implicated in this case. He further submits that the offences alleged against the accusedpetitioners are exclusively triable by Magistrate. The accusedpetitioners are in custody since long and there are no criminal antecedents against the accused-petitioners, the trial/investigation of the case may take considerable time, therefore, these bail applications of the accused-petitioners may be allowed.

Learned Public Prosecutor vehemently opposes the bail applications.

Heard and perused the material available on record.

Considering the fact that the matter is exclusively triable by Magistrate and there are no criminal antecedents against the accused-petitioners, the trial/investigation of the case may take considerable time, without commenting further anything on the merits of the case, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, these bail applications under Section 483 BNSS are allowed and it is ordered that the accused-petitioners namely

1. Ansar S/o Sher Mohammad, 2. Sarafraj S/o Harun, 3. Arsad S/o Ayub, 4. Saraba S/o Rahman, in connection with FIR No. 39/2025 registered at Police Station Pahari, District Deeg shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/each to the satisfaction of the learned trial Judge for their appearance before the court concerned on all the dates of hearing and as and when called upon to do so.
