These instant bail applications have been filed under Section 483 of B.N.S.S. on behalf of accused-petitioners. The accusedpetitioners have been arrested in connection with FIR No.25/2025, registered at Police Station Vishwakarma, District Jaipur (West), for the offence(s) under Sections 303(2) of B.N.S.

Learned counsel for the petitioners submits that the accusedpetitioners have falsely been implicated for the offences under Section 303(2), 347(1), 317(2), 249 and 111 of B.N.S. The accused-petitioners are in custody since 02.02.2025 and further trial of the case may take considerable time. The other co-accused Mohammed Mainuddin Ansari and Rajeev have already been enlarged on bail by order of this Court and the learned Sessions Court respectively. It is also contended that the case of the present petitioners are akin to the case of the other co-accused Rajeev, therefore, these bail applications of the accusedpetitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the grant of bail applications. It is contended that the petitioners in connivance with the other co-accused committed theft of complainants truck and thereafter sold it to Mohammed Mainuddin. The petitioners are also involved in similar nature of case and the FIR is registered against the present petitioners for the offences under Sections 408, 411 and 120-B of IPC in Police Station Vishwakarma, therefore the bail applications of the accused-petitioners may be dismissed.

Heard and perused the material available on the record.

It is not desirable to express anything on the merits of the case, the accused-petitioners are in custody since 02.02.2025, trial of the case may take considerable time and the other coaccused have already been enlarged on bail by order of this Court and the learned Sessions Court, therefore, I deem it just and proper to enlarge the accused-petitioners on bail.

Accordingly, these bail applications under Section 483 of B.N.S.S. are allowed and it is ordered that the accused-petitioners namely; 1. Dhiraj Kumar S/o Shree Kisoon Dev Singh, 2. Dharmendra Kumar Singh S/o Late Shree Janardan Singh, 3. Sunny Kumar S/o Shree Vinod Prasad Shrivastav and 4. Upendra Singh S/o Late Shree Janardan Singh, in connection with FIR No.25/2025, registered at Police Station Vishwakarma, District Jaipur (West), shall be enlarged on bail provided each of them furnish a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for their appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.

The accused-petitioners are also directed to mark their presence on 25^th of every month till conclusion of trial before the concerned Police Station. The SHO of the concerned Police Station shall send the presence report of the accused-petitioners to the trial Court, every month. In case of any breach to the above condition, the learned Public Prosecutor shall be free to move the applications against the petitioners for cancellation of the bail before the concerned Court.
