The present bail application has been filed by the accusedapplicants under Section 483 of the B.N.S.S, 2023 against the order dated 14.02.2025 passed by learned Additional Sessions Judge No.01, Bundi (Raj.) in connection with FIR No. 0028/2025, registered at Police Station Kesherai Patan, District Bundi (Raj.) for the offences punishable under Sections 115(2), 126(2), 109(1), 189(2) of BNS, 2023, by which the bail application of the accused-applicants under Section 483 of the B.N.S.S, 2023 has been dismissed.

Learned counsel for the accused-applicants submits that the accused-applicants have falsely been implicated in this matter. Learned counsel argues that as per the FIR, the allegation of causing injury to injured-Chetan by sharp edged weapon is on Aaryan @ Sachin and not on the present accused-applicants. Learned counsel also argues that the accused-applicants are about 18 years of age and were arrested on 27.02.2025 and since then, they are behind the bars. Learned counsel prays that charge-sheet has been filed and trial will take long time to conclude, therefore, the accused-applicants be enlarged on bail.

On the other hand, learned Public Prosecutor opposes the bail application. 4. Heard learned counsel for the parties and also perused the material available on record. 5. Having regard to the facts and circumstances of the case and considering the facts that in this case injured-Chetan has received three injuries on his abdomen by sharp edged weapon, however, the allegation of causing such injuries by sharp edged weapon is on Aaryan @ Sachin and not on the present accusedapplicants; that the charge-sheet has been filed and trial will take long time to conclude, but without expressing any opinion on the merits/demerits of the case, this Court deems it proper to allow the bail application filed by the accused-applicants.

Consequently, this bail application filed under Section 483 of the B.N.S.S, 2023 is allowed. It is ordered that accusedapplicants namely; 1. Kishan S/o Shri Meghraj and 2. Preetam S/o Brahmanand , arrested in FIR No. 0028/2025,

registered at Police Station Kesherai Patan, District Bundi (Raj.) shall be released on bail; provided each of them furnishes personal bond in the sum of Rs.50,000/- each and two solvent sureties of Rs.25,000/- each to the satisfaction of the learned trial Court.

The Accused-Applicants shall be required to appear before that Court on all dates of hearing and as and when called upon to do so.
