The instant bail application has been filed under Section 483 of B.N.S.S. on behalf of accused-petitioner. The accused-petitioner has been arrested in connection with FIR No.60/2024, registered at Police Station Masalpur, District Karauli, for the offence(s) under Sections 143, 323 and 341 of IPC.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated for the offences under Sections 143, 323, 341, 325 and 307 of IPC. It is contended that the injuries sustained to injured Dharmendra Singh are not attributed to the present accused-petitioner, the allegation against the accused-petitioner is omnibus in nature and the FIR was lodged against the 10 persons. It is also contended that injured Dharmendra Singh only received one injury at his head and the

other injured received two injuries, which were found to be simple blunt in nature. It is also contended that the cross case was also lodged by the petitioner-party against the complainant-party and in that case the charge-sheet has already been submitted against the complainant-party. There was no intention at the part of the accused-petitioner to cause murderous injuries to any injured, the accused-petitioner is behind the bars since 19.01.2025 and trial of the case may take considerable time, therefore, the bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor as well as learned counsel appearing on behalf of the complainant have vehemently opposed the grant of bail application. It is argued that the accusedpetitioner along with the other co-accused assaulted at injured Dharmendra Singh, resulting into fracture of parietal bone. Therefore, considering the allegations levelled against the accused-petitioner, the bail application may be dismissed.

Heard and perused the material available on the record. 5. It is not desirable to express anything on the merits of the case. Considering the fact that the injured in his statement rendered under Section 161 of Cr.P.C. has specifically attributed the injuries to the other co-accused Sudhir. In the FIR as well as in the statement of witnesses rendered under Section 161 of Cr.P.C. the allegations are omnibus in nature. The accused-petitioner is in custody since long and trial of the case may take considerable time, I deem it just and proper to enlarge the accused-petitioner on bail.

Accordingly, the bail application under Section 483 of B.N.S.S. is allowed and it is ordered that the accused-petitioner-

Soma @ Jaikishan Jadaun S/o Shri Chandrabhan Singh Jadaun, in connection with FIR No.60/2024, registered at Police Station Masalpur, District Karauli, shall be enlarged on bail provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties of Rs.25,000/- each to the satisfaction of the learned trial Judge for his appearance before the Court concerned on all the dates of hearing and as and when called upon to do so.
