The instant bail application has been filed under Section 483 of BNSS on behalf of the petitioner, who has been arrested in connection with FIR No.435/2024 registered at Police Station KhoNagoriyan, District Jaipur City (East) for the offences under Sections 420, 406, 467, 468, 471 & 120B of IPC.

It is contended by learned counsel for the petitioner that the accused-petitioner has falsely been implicated in this case. Learned counsel submit that false allegations have been levelled against the petitioner. It is submitted that in fact, there is money dispute between the parties as petitioner could not repay

Rs.5,00,000/- which was borrowed by him from the complainant. Learned counsel contend that alleged offences are triable by Magistrate for which maximum offence is seven years. It is contended that petitioner has no criminal antecedents of similar nature and he is in custody since his date of arrest. Charge-sheet has been filed and trial will take time in its conclusion.

Learned Public Prosecutor assisted by learned counsel for the complainant vehemently oppose the submissions made by the learned counsel for the petitioner. Learned counsel for the complainant submits that there is allegation against the petitioner that he induced the complainant to give money to him to ensure the govt. employment for the complainant’s son.

I have considered the contentions. 5. Having regard to the totality of the facts and circumstances of the case; considering the arguments advanced by learned counsel for the parties, as also the fact that alleged offences are triable by Magistrate; petitioner has no criminal antecedents of similar nature; charge-sheet has been filed and trial will take time in its conclusion, but without commenting anything on the merits/demerits of the case, I deem it proper to allow the bail application.

This bail application is accordingly allowed and it is directed that accused-petitioner - Kailash Chand Meena S/o Shri Shrwan Lal Meena, shall be released on bail provided he furnishes a personal bond in the sum of Rs.50,000/- (Rupees Fifty Thousand Only) together with two sureties in the sum of Rs.25,000/- (Rupees Twenty Five Thousand Only) each to the

satisfaction of the learned trial Court with the stipulation that he shall appear before that Court and any Court to which the matter is transferred, on all subsequent dates of hearing and as and when called upon to do so.
