Apprehending his arrest in connection with FIR No.41/2024, registered at Police Station Ucchain, District Bharatpur for the offence(s) under Section 8/20 of the N.D.P.S., the accusedpetitioner has preferred this criminal misc. bail application under Section 482 of B.N.S.S.

Learned counsel for the accused-petitioner submits that the accused-petitioner has falsely been implicated under Section 8/25 of the N.D.P.S. Act, solely on the ground that the motorcycle of the accused-petitioner was found with the other co-accused, who was carrying the contraband articles with him and the accusedpetitioner was not aware that motorcycle was used for transporting the contraband articles. The accused-petitioner was arrested after 8 months of registering of the FIR, there are no criminal antecedents against the accused-petitioner, regarding

involvement in N.D.P.S. cases and the accused-petitioner is ready and willing to co-operate with the investigation, therefore, the anticipatory bail application of the accused-petitioner may be allowed.

Learned Public Prosecutor vehemently opposes the anticipatory bail application of the accused-petitioner.

Heard and perused the material available on the record.

Considering the fact that the recovery of contraband articles were effected from the other co-accused, without expressing anything on the merits of the case, I deem it just and proper to allow the anticipatory bail application of the accused-petitioner.

Accordingly, the anticipatory bail application under Section 482 of B.N.S.S. is allowed and it is ordered that in the event of arrest of the petitioner- Chinno @ Chandrashekhar Son Of Shri Popsingh, in connection with FIR No.41/2024, registered at Police Station Ucchain, District Bharatpur, he shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/with two sureties in the sum of Rs.25,000/- each to the satisfaction of the S.H.O/I.O/Arresting Officer of the concerned Police Station on the following conditions:-

(i) that the petitioner shall make himself available for interrogation by a police officer as and when required;

(ii) that the petitioner shall not directly or indirectly make any inducement, threat or promise to any person acquainted with the facts of the case so as to dissuade him from disclosing such facts to the court or any police officer, and

¶25

(iii) that the petitioner shall not leave India without previous permission of the court.
