This bail application has been filed by the petitioner under Section 483 of B.N.S.S. in connection with FIR No.279/2025 registered at Police Station Kotputli, District Kotputli-Behror for the offence(s) under Section(s) 308(2), 326(g), 351(2), 3(5) of B.N.S. and Section(s) 3/25 of Arms Act.

Learned counsel for the petitioner submits that the accused-petitioner is innocent and he has been falsely implicated in this case. Learned counsel for the petitioner submits that coaccused person has already been enlarged on bail by the coordinate Bench of this Court. He also submits that the accusedpetitioner has been in judicial custody since long and the conclusion of the trial will take long time, hence the petitioner may be enlarged on bail.

Learned Public Prosecutor appearing for the State has vehemently opposed the bail application.

Taking into consideration the overall facts and circumstances of the case and the fact that co-accused person has already been enlarged on bail by the coordinate Bench of this Court; perused the material available on record the accused-petitioner has been in judicial custody since long but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Therefore, this bail application is allowed and accused-petitioner Nitin @ Najim S/o Shyonarayan is ordered to be released on bail provided he furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.

It is made clear that the accused-petitioner shall not involve in any other offence(s) during currency of the bail and he shall mark his presence in first week of every month in the concerned Police Station, till trial is concluded.

Concerned SHO is directed to maintain a register recording the attendance of the petitioner, as directed above. In case the petitioner fails to mark his presence in the concerned Police Station, as directed above, the concerned SHO is directed to immediately report the matter to the concerned Court in this regard.

If any breach of these conditions is reported or come to the notice of the Court, the same shall alone be a reason for the trial Court to cancel the bail granted to him by this Court.

Office is directed to send a copy of this order to the concerned SHO for necessary compliance.

The observations made hereinabove are only for decision of the bail application and would not have any impact on the trial of the case in any manner.
