These bail application have been filed by petitioners under Section 483 BNSS/439 Cr.P.C. seeking regular bail in FIR No.237/2025 registered at Police Station Adarsh Nagar, District Jaipur City (East) for the offence(s) under Section(s) 8/21 of NDPS Act.

Learned counsel for petitioners submits that accusedpetitioners are innocent and they have been falsely implicated in these cases. Learned counsel further submits that allegation

against accused-petitioner-Neeraj Sansi is recovery of 16 grams of smack which is less than commercial quantity and although other cases are there against petitioner-Neeraj Sansi, none are under the NDPS Act. Regarding petitioner-Vicky Kumar, counsel has submitted that he is just the owner of the Motor Cycle and there is no recovery from him. Learned counsel also submits that accusedpetitioner have been in judicial custody since long and the conclusion of the trial will take long time, hence petitioners may be enlarged on bail.

Learned Public Prosecutor appearing for the State has opposed the bail applications.

Taking into consideration the overall facts and circumstances of the case and the fact the alleged contraband in the case is less than commercial quantity, but without expressing any opinion on the merits and demerits of these cases, this Court deems it just and proper to enlarge petitioners on bail.

Accordingly, these bail applications filed under Section 483 BNSS/439 Cr.P.C. are allowed and it is ordered that accusedpetitioners 1.Neeraj Sansi S/o Kamaljeet Sansi & 2.Vicky Kumar S/o Shri Umrao Kanjar shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.1,00,000/- with two sureties of Rs.50,000/- each to the satisfaction of the trial Court, with the stipulation that petitioners shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
