This bail application has been filed by the petitioner under Section 483 BNSS/439 Cr.P.C. seeking regular bail in FIR No.218/2025 registered at Police Station Pushkar, District Ajmer for the offence(s) under Section(s) 115(2), 117(1), 189(2), 307, 331(6), 324(2) & 351(2) of BNS.

Learned counsel for the petitioner submits that the accusedpetitioner is innocent and he has been falsely implicated in this case. Learned counsel further submits that a compromise has been arrived at between the parties and a copy of the same has been placed on record. Learned counsel also submits that the accused-petitioner has been in judicial custody since long and the conclusion of the trial will take long time, hence the petitioner may be enlarged on bail.

complainant-Mr. Asad Ul Haq Nooree has not disputed the aforementioned submission of the learned counsel for the petitioner.

Heard learned counsel for the parties.

The facts of the case reveals that the petitioner along with other co-accused entered into the hotel at night, attacked the complainant and his brother and caused injuries. The order of the trial court dated 03.10.2025 reveals that the other co-accused have been granted bail but the bail of the petitioner has been refused on the ground of his antecedents.

Taking into consideration the overall facts and circumstances of the case, looking to the fact that a compromise has been arrived at between the parties and that the offences are triable by Magistrate, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application filed under Section 483 BNSS/439 Cr.P.C. is allowed and it is ordered that accusedpetitioner Prahlad Gurjar S/o Shri Gordhanlal shall be released on bail, provided he furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
