These bail applications under Section 483 B.N.S.S. have been filed by petitioners in connection with the FIR No.911/2025

registered at Police Station Kardhani, District Jaipur (West) wherein they have been charged for the offences punishable under Sections 331(3) & 305(a) BNS and Section 3/25 of the Arms Act.

Learned counsel for the petitioners submits that the alleged offences are triable by the Magistrate. Learned counsel for the petitioners further submits that the petitioners are in custody since the date of their arrest and the trial will take its own time to conclude, therefore indulgence of bail be granted to the petitioners.

Per contra, learned Public Prosecutor opposes the bail applications and submits that 11 cases of similar nature have been registered against the petitioner-Vishal Malawat and 3 cases of similar nature have been registered against the petitioner-Shyam Tailor and the matter is with the investigation agency, so the petitioners do not deserve any indulgence of bail.

Heard and considered the submissions made at the Bar and perused the material available on record. 5. Considering the arguments put forward by learned counsel for the rival sides, and also considering the fact that the petitioner-Shyam Tailor has been in custody since the date of his arrest and the trial will take its own time to conclude, without expressing any opinion on merits and demerits of the case, this Court deems it just and appropriate to grant indulgence of bail to the petitioner-Shyam Tailor under Section 483 BNSS.

Accordingly, the bail application No.13533/2025 under Section 483 B.N.S.S. is allowed and it is ordered that the accusedpetitioner- Shyam Tailor Son Of Shri Kishan Lal Tailor arrested in connection with aforementioned FIR, may be released on bail;

provided he furnishes a personal bond of Rs.50,000/- with two surety bonds of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing, as and when called upon to do so.

Looking to the fact that against the petitioner-Vishal Malawat, there are 11 cases of similar nature are registered, which are pending, therefore, the bail application No.13329/2025 under Section 483 BNSS stands rejected. However, the petitionerVishal Malawat would be at liberty to move application for revival of his prayer for bail after completion of investigation.
