This bail application has been filed by the petitioner under Section 483 BNSS seeking regular bail in FIR No.50/2025 registered at Police Station Raja Khera District Dholpur for the offence(s) under Section(s) 318(4), 338, 336(2), 336(3) and 340 (2) of BNS.

Learned counsel for the petitioner submits that the petitioner is innocent and she has been falsely implicated in this case. Learned counsel further submits that the petitioner was selected in the year 2005 as Level-1 Teacher and since then she is in service. Now, the FIR came to be lodged at the instance of the District Education Officer, Dholpur where it is alleged that her High School Marksheet of the year 1994 and Intermediate Marksheet of 1996 is forged. Learned counsel for the petitioner submits that

she is in judicial custody since 15.09.2025. The offence(s) are triable by Magistrate and the conclusion of the trial will take long time, hence the petitioner may be enlarged on bail.

Learned Public Prosecutor appearing for the State has opposed the bail application.

Heard learned counsel for the parties.

The petitioner is in service and is working as Teacher (Level-I) in the Education Department. The incident is of the year 2005 and involvement of the petitioner would be adjudicated in the trial.

Taking into consideration the overall facts and circumstances of the case, and the fact that the offence(s) are triable by Magistrate, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge the petitioner on bail.

Accordingly, the bail application filed under Section 483 BNSS is allowed and it is ordered that accused-petitioner Moni Devi W/o Sovaran Singh , shall be released on bail, provided she furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that the petitioner shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
