These bail applications have been filed by petitioners under Section 483 BNSS/439 Cr.P.C. seeking regular bail in FIR No.179/2025 registered at Police Station Tehla, District Alwar for the offence(s) under Section(s) 115(2), 127(2), 140(3), 310(2) & 112 of BNS.

Learned counsel for petitioners submits that accusedpetitioners are innocent and they have been falsely implicated in this case. Learned counsel further submits that accusedpetitioners have not been named in the FIR and the allegation against them is that they picked up two persons namely, Anil Prajapat and Rajendra Prajapat when they were returning home in the evening and thereafter they were beaten up and accusedpetitioners demanded twenty thousand Maxi Dollar (which is some kind of cryptocurrency) and thereafter they snatched their phone, took money from them and left them on Jaipur Bharatpur road. Learned counsel also submits that investigation against petitioners is complete and nothing is to be recovered from them. Learned counsel also submits that accused-petitioners namely, Harkesh Meena and Sourabh Meena have one case each pending against them whereas all other petitioners have no criminal antecedents. Learned counsel further submits that accused-petitioners have been in judicial custody since long and the conclusion of the trial will take long time, hence petitioners may be enlarged on bail.

Learned Public Prosecutor appearing for the State has opposed the bail application but is not in a position to dispute that there is no recovery from accused-petitioners.

Taking into consideration the overall facts and circumstances of the case and the fact that petitioners have not been named in the FIR, investigation against them is complete, nothing is to be recovered from them and apart from Harkesh Meena and Sourabh Meena who have one case each pending against them, all other petitioners have no criminal antecedents, but without expressing any opinion on the merits and demerits of the case, this Court deems it just and proper to enlarge petitioners on bail.

Accordingly, the bail application filed under Section 483 BNSS/439 Cr.P.C. is allowed and it is ordered that accusedpetitioners 1.Dharam Singh Meena S/o Budhram Meena, 2.Ankush Meena S/o Shri Harikesh Meena, 3.Harkesh Meena S/o Shri Batturam, 4.Sourabh Meena S/o Lakhanlal Meena, 5.Roop Singh Meena S/o Shri Ramjilal Meena, 6.Ajay Meena S/o Rambabu Meena, 7.Ajay Kumar Meena S/o Shri Harimohan Meena, 8.Sher Singh Meena S/o Late Shri Ramjilal Meena & 9.Sachin Kumar Meena S/o Shri Mitthanlal Meena shall be released on bail, provided each of them furnishes a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each to the satisfaction of the trial Court, with the stipulation that petitioners shall appear before that Court on all subsequent dates of hearing and as and when called upon to do so.
