The instant bail application has been filed under Section 483 BNSS on behalf of accused-applicant. The accused-applicant was arrested in connection with FIR No. 133/2025 registered at Police Station Mehandipur Balaji, District Dausa for the offence(s) under Sections 189(2), 115(2), 126(2), 3(5), 333, 109(1) of BNS and Section 3/25 and 5 of Arms Act.

Learned counsel for the applicant has submitted that the applicant is aged approximately 43 years. It is submitted that the applicant is neither named in the FIR nor is having any connection with the property in dispute. It is also submitted that the alleged injuries are simple in nature. It is further submitted that the challan has been filed and the applicant is in custody ever since 02.09.2025.

Per contra , learned Public Prosecutor and counsel for the complainant have opposed the bail application. It is submitted that the applicant has concealed the fact of passing of prohibition order on account of property dispute.

Heard and considered.

Considering the arguments advanced by the counsel for the parties, the fact that applicant has concealed the fact of passing of prohibition order on account of property dispute and on previous occasion, physical altercation is taken place on account of which, prohibition order has been passed; that Section 109 of BNSS is made applicable, this Court is not inclined to entertain the present bail application.

Accordingly, the present bail application is dismissed.
