Criminal Miscellaneous Bail Application No. 11973/2025) and, in the connected application No. 12161/2025, by Deshraj and Sunil, in respect of FIR No.154/2025 of Police Station Mokhampura, District Jaipur Rural, for offences under Sections 19, 54 and 54(A) of the Rajasthan Excise Act, were allowed. Counsel pleaded false implication, absence of criminal antecedents, and an allegation of possession of 8,000 bottles of illegal liquor, submitting that no custodial interrogation or recovery was warranted and the trial would take considerable time; the Public Prosecutor opposed. Heard learned counsel for the petitioners as well as learned Public Prosecutor and perused the material available on record.

Learned counsel for the petitioners submits that the petitioners have falsely been implicated in these cases. He further submits that though there is an allegation against the petitioners of being in possession of 8,000 bottles of illegal liquor but there are no criminal antecedents against any of the petitioners. The petitionerSaddam Hussain is in custody since 23.08.2025, and the other coaccused are behind the bars since 17.08.2025. No custodial interrogation or recovery is warranted. The trial of the case may take considerable time, therefore, no fruitful purpose would be served by keeping the petitioners in further custody, hence, the bail applications of the petitioners may be allowed.

Learned Public Prosecutor has vehemently opposed the bail applications.

On consideration of the rival submission and material available on record and deliberating all the facts and circumstances of the case, and without expressing any opinion on the merits/demerits of the case, I am inclined to grant benefit of bail to the petitioners. 6. Accordingly, the bail applications under Section 483 B.N.S.S. are allowed and it is ordered that the petitioners- Saddam Hussain S/o Mahrajudeen, Deshraj S/o Gyanchand and Sunil S/o Late Sh. Rajendra Kumar shall be released on bail on their furnishing a personal bond in the sum of Rs.50,000/- with two sureties of Rs.25,000/- each of them to the satisfaction of the
