This second bail application under Section 483 of BNSS has been filed on behalf of the petitioner, who has been arrested in connection with FIR No.124/2023 registered at Police Station Bahrawanda Kalan, District Sawai Madhopur (Rajasthan) for offences punishable under Sections 302 & 506 of IPC. After completion of investigation, police filed charge-sheet in this matter.

The first bail application filed on behalf of the petitioner was dismissed by this court vide order dated 13.01.2025. Now, this second bail application has been preferred.

Learned counsel appearing for petitioner submits that petitioner has falsely been implicated in this case. Counsel submits that complainant of this case has moved an application before the learned trial Court mentioning therein that he was carried away by emotions when he filed the FIR. Counsel submits that eyewitnesses namely- Radhika @ Radha & Vishakha (daughters of petitioner and deceased) have not supported the prosecution case

and they have been declared hostile. It is contended that trial will take considerable time in its conclusion. Counsel submits that petitioner is in custody since 03.12.2023 and further custody of the petitioner would not serve any fruitful purpose.

Learned State counsel opposes the submissions made by counsel for the petitioner. 5. I have heard both the parties and perused the material available on record.

After considering the nature of allegation and evidence available against the petitioner, first bail application was dismissed and it was observed that there is allegation against the petitioner that he gave beatings to his wife with Maugari and killed her. It was further observed that murder was committed in the house of the petitioner despite this, petitioner did not report the matter to the police and he did not make himself available to the police during the course of investigation which prima facie shows his involvement in the crime. Apart from this, as per report received from the learned trial Court, only two witnesses are remaining to be examined and as such, trial is at fag end. Hence, this second bail application stands dismissed.

Learned trial Court is directed to expedite the proceedings and culminate the trial preferably on or before 31.03.2026.

The observations made hereinabove are only for decision of the bail application and would not prejudice the trial in any manner.
