Instant application for bail is filed under Section 483 of BNSS by the applicants-accused Sandeep Singh S/o Shri Prahlad and Udaibhan S/o Shri Jwan Singh in FIR No. 92/2025 dated 15.05.2025 registered at P.S. Mansalpur District -Karauli, whereby the applicants-accused were charged under Sections 115(2), 126(2), 189(2) and 303(2) of BNS.

The applicants were arrested and are in judicial custody since their arrest. The Court below has dismissed the bail application.

Learned counsel for the applicant relying upon grounds raised in bail application submits that the applicants are innocent and falsely implicated in the present case. Further, submits that the investigation relating to present applicantsaccused is complete and are no more required by the Investigating Agency for investigation. He further assures that in case, the applicants-accused are required the applicants-accused will be available. He also submits that the trial will take time and no purpose will be served by keeping the applicants-accused in custody.

Learned counsel for petitioners submitted that for incident of 14.05.2025, report is registered after a delay on 15.05.2025. He further submitted that during investigation, injured Vijendra is examined by doctor and except injury Nos. 11, 15 and 17, all injury Nos. 11, 15 and 17 are found as simple in nature and were not on vital parts. He further submitted that there was a land dispute between the parties and a report is registered due to previous animosity. He further submitted that petitioners are young boys and they undertake not to repeat the offence.

Aforesaid contentions were opposed by learned Public Prosecutor and learned counsel for complainant. Learned counsel for complainant has submitted that accused has posted pictures on social media to intimidate and terrorize people including the complainant. He further submitted that

if petitioners are released on bail, then they will again indulge in criminal activities and threater complainant party.

1. Heard learned counsel for the parties and learned Public Prosecutor. Perused the material placed on record.

On the basis of parchabayan of injured Vijendra Singh about assault by Uday, Sandeep and Ors. a report is registered and during investigation both petitioners were arrested. The medical jurist has prepared injury report of injured Vijendra and found 20 injuries on body of Vijendra and out of them, injury Nos. 11, 15 and 17 were grievous in nature. The police has found involvement of petitioners and found that there is previous animosity between the parties due to land dispute. There is no criminal antecedent against the petitioners. The photographs submitted by learned counsel for complainant indicated that one of the petitioner has captured photograph with a gun and same is posted on social media. Except injury Nos. 11, 15 and 17, all others were simple in nature and they are bruises. Injury No.11 is upon hand, injury No. 15 is upon left ankle joint and injury No.17 is upon right knee joint.

Upon hearing the arguments and perusing the record, we have found that the applicants-accused are no more required in the investigation and they are in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicants-accused. We are passing the bail order after

taking note of alleged intimidation and terrorizing complainant injured by petitioners.

Thus, the instant bail application filed on behalf of applicants-accused Sandeep Singh S/o Shri Prahlad and Udaibhan S/o Shri Jwan Singh , is hereby allowed and the applicants-accused are ordered to be released on bail with condition that each of the petitioners would furnish a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-

(i) The applicants-accused shall not tamper with evidence or influence the witness in any manner.

(ii) The applicants-accused will mark their attendance on 3^rd Monday of every month at P.S. Mansalpur Dist. Karauli.

(iii) The applicants-accused shall withdraw all photographs from visible social media (Facebook, Instagram etc.), posted with any kind of arm including fire arm and in future they will not post any post to intimidate complainant or injured.

(iv) The applicants-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

(v) The applicants-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court.

(vi) In case of any violation of above conditions, the bail granted to the applicant-accused shall be liable to be canceled.
