The present bail applications under Section 483 of BNSS are filed by the applicants-accused Ansar S/o Mehmood, Nisar S/o Mehmood, Israel S/o Rujdar and Sajid S/o

Zakar, seeking bail in respect of a criminal case registered as FIR No.123/2024 dated 30.05.2024 registered at P.S. Khoh District – Deeg, for the offence under Sections 419, 420, 468, 471 and 120B IPC and 66D of IT Act.

Learned counsel for the applicants submits that the applicants have been falsely implicated in the matter and the investigation against them is complete and they are no more required in investigation. He further submits that there are no chance of fleeing of applicants accused from the jurisdiction of this Hon’ble Court. The applicant does not have any criminal antecedents. He also submits that the applicants undertake not to repeat offence and cooperate with investigation/trial, which will take time.

Learned counsel for applicants submits that these applicants were not detained on 30.05.2024 when police has intercepted four persons- Hariom, Sahil S/o Usman, Sahil S/o Jaikam Khan and a juvenile Farhan S/o Abid. He also submitted that during investigation main accused has revealed the name of these applicants and on basis of information of co-accused present applicants were arrayed as an accused. He further submits that Hariom, Sahil S/o Usman and Sahil S/o Jaikam Khan were released on bail by a Co-ordinate bench on 08.11.2024 whereas Shakil and Mausam were released on bail by Trial Court itself. He also submits that these applicants are not involved in any criminal activity and there is no criminal antecedents against them except one case against Israel.

Learned Public Prosecutor has vehemently opposed the bail application and submitted that the allegations are grave and serious in nature.

Heard learned counsel for the petitioners-accused and learned Public Prosecutor. Perused the material placed on record by both the parties.

On basis of a police search on 30.05.2024 and detention of four accused Hariom, Sahil S/o Usman, Sahil S/o Jaikam Khan and a juvenile, a case is registered and matter is investigated. Three appellants Hariom, Sahil S/o Usman, Sahil S/o Jaikam Khan were released on bail by Co-ordinate bench of this Court on 08.11.2024 in bail application No. 7334/2024. Co-accused Shakil and Mausam @ Mausmeen, also arrested during investigation were released by learned Additional Sessions Judge, Deeg on 22.08.2025 and 13.05.2025 respectively. There is no criminal antecedents against Sajid, Ansar and Nisar but a criminal case under Section 3/25 of Arms Act is registered against Israel.

Upon hearing the arguments and perusing the record, we have found that the applicants-accused are no more required in the investigation and they are in custody for quite some time. The further proceedings will take its own time, therefore, looking to entirety of facts and circumstances of the case and without expressing any opinion on merits of the case, the Court deems it appropriate to grant bail to the applicants-accused.

Thus, the instant bail applications filed on behalf of applicants-accused Ansar S/o Mehmood, Nisar S/o

Mehmood, Israel S/o Rujdar and Sajid S/o Zakar, , are hereby allowed and the applicants-accused are ordered to be released on bail with condition that each of the petitioners would furnish a personal bond of ₹50,000/- with two sureties of like amount to the satisfaction of the Trial Court with the following conditions:-

(i) The applicants-accused shall not tamper with evidence or influence the witness in any manner.

(ii) The applicants-accused shall not indulge in any criminal activity and shall not repeat any criminal offence punishable under the Law.

(iii) The applicants-accused shall attend the hearing of the Trial Court on the date fixed by the Trial court or as and when asked to appear before the Trial Court.

(iv) In case of any violation of above conditions, the bail granted to the applicants-accused shall be liable to be canceled.

The Registry is directed to send a copy of this order to the Trial Court through E-mail.
