This criminal miscellaneous application has been filed for releasing the demand draft of Rs.10,000/- deposited by the applicant in favour of the non-applicant/respondent as litigation expenses, in compliance of the order dated 13.10.2023 passed by this Court in S.B. Criminal Revision Petition No.1487/2023.

Learned counsel for the applicant submits that the applicant filed a revision petition against the order passed by the Competent Magistrate under Section 125 Cr.P.C. for granting maintenance to the non-applicant/respondent @ Rs.15,000/- per month. This Court while issuing notice to the non-applicant/respondent also

directed to deposit Rs.10,000/- as litigation expenses to be paid to the non-applicant/respondent. Learned counsel further submits that before issuing the notices to the respondent, the dispute was amicably settled between the parties and applicant/petitioner withdrew the petition and the same was dismissed as withdrawn vide order dated 21.05.2024. In the meanwhile, the applicant deposited demand draft of Rs.10,000/- before the Registrar (Judicial) of this Court. This application is filed for releasing the demand draft back to the applicant.

Looking to the facts and circumstances of the case and the fact that the parties have settled their dispute amicably and all the matters pending between the parties have been settled and also that the notices for respondent were not issued, it is directed that the demand draft of Rs.10,000/- deposited by the applicant in favour of the non-applicant/respondent be returned to the applicant.

With the above directions, this criminal miscellaneous application is disposed of.
