The instant misc. application has been submitted seeking modification of the order dated 16.04.2024 passed by this Court while deciding S.B. Criminal Misc. Suspension of Sentence Application (Appeal) No.307/2024 in S.B. Criminal Appeal No.373/2024.

Learned counsel for the applicant submits that sentence of the appellant/applicant was suspended by this Court vide order dated 16.04.2024 and the appellant was directed to deposit the fine amount within a period of one year from the date of his release. Learned counsel submits that the appellant could not

arrange the sureties, hence, he could not be released immediately, however, he was released from the Central Jail, Jaipur on 11.04.2025. Learned counsel submits that the appellant undertakes that he will comply with the order dated 16.04.2024 passed by this Court and deposit the entire fine amount pursuant to the aforesaid order within a period of one year from the date of his release, so appropriate directions be issued.

Considering the arguments put forward by learned counsel for the petitioner and the averments made in the application, the same is allowed. The order dated 16.04.2024 passed by this Court stands modified. The appellant is directed to deposit the fine amount on or before 11.04.2026.

It is made clear that, in case, the appellant fails to deposit the aforesaid amount within the aforesaid period, appropriate action would be taken against him strictly in accordance with law.

Let a copy of this order be sent to the Trial Court seeking necessary compliance of the order.
