It is contended by learned AGA that husband and mother-inlaw were acquitted for offence under Section 306 IPC and in the alternate for offence under Section 302/34 of IPC. It is also contended that initially witnesses during police investigation had given statement with regard to abetment of suicide.

We have considered the contentions and perused the judgment as well as the record.

From perusal of the same, it is revealed that all the witnesses who had during police investigation given evidence with regard to instigation, have turned hostile.

Present is a case where two marriages took place on the same day. Sister of accused-respondent No.1 was married in the

family of complainant and complainant’s daughter was married to the accused-respondent No.1. The death has taken after seven years of marriage and there is no evidence with regard to any cruelty or instigation. Learned Trial Court has appropriately appreciated the evidence and has not committed any illegality in acquitting the accused, hence, we are not inclined to entertain the leave to appeal.

Criminal Leave to Appeal is accordingly, dismissed.
