The present bail cancellation application under Section 439 (2) Cr.P.C. has been filed by the petitioner seeking cancellation of bail granted to the accused-respondents by the learned Additional Sessions Judge, Laxmangarh, District Alwar (for brevity “the learned Additional Sessions Judge”) vide order dated 09.11.2023 passed in Bail Application No.278/2023 CIS No.235/2023 in connection with FIR No.0132/2021 registered at Police Station Laxmangarh, District Alwar for the offence(s) under Section(s) 147, 148, 149, 323, 341, 447, 302 & 307 IPC and later on for the

In pursuant to the direction of this Court dated 08.08.2024, learned Public Prosecutor has submitted the status report dated nill furnished by the Station House Officer, Police Station Laxmangarh, District Alwar which reflects that the prosecution evidence is over and the case is fixed for recording the accused plea. It does not reflect any averment that the accusedrespondents have misused the liberty of bail extended to them by the learned Additional Sessions Judge vide order dated 09.11.2023.
In view thereof, no case for cancellation of bail granted to the respondents vide order dated 09.11.2023 is made out at the fag end of trial.
This application seeking cancellation of bail is dismissed accordingly.
