The instant appeal has been filed under Section 14A(2) SC/ ST (Prevention Of Atrocities) Act on behalf of the appellant, who is in custody in connection with FIR No. 309/2024 Police Station Sadar Sikar, District Sikar for the offences under Sections 115(2), 126(2), 119(1), 307, 3(5) of BNS, 2023 and Sections 3(1)(r), 3(1) (s), 3(2)(va) of the SC/ST (Prevention Of Atrocities) Act.

Learned counsel for the appellant has submitted that appellant is in custody ever-since 17.07.2025. It is submitted that no criminal antecedents are registered against him and appellant is sole bread earner of the family. It is further submitted that co-accused is enlarged on bail.

Per contra , learned Public Prosecutor has opposed the appeal.

Considering the submissions made by the learned counsel for the appellant and taking note of the fact that appellant is sole bread earner of the family; that co-accused is enlarged on bail under akin factual matrix, this Court, in the interest of justice, deems it apposite to allow the present appeal.

Consequently, the instant appeal is allowed. The impugned order dated 26.08.2025 passed by the Special Judge, SC/ST (Prevention Of Atrocities) Cases, Sikar (Rajasthan) is set aside. It is ordered that the accused-appellant Sugan Singh Charan S/o Late Shieshdan arrested in connection with aforesaid FIR, shall be released on bail, if not wanted in any other case, provided he furnishes a personal bond of Rs.50,000/- and two sureties of Rs.25,000/- each to the satisfaction of the learned trial Court with the stipulation to appear before that Court on all dates of hearing and as and when called upon to do so.
