As a result, the instant appeal agrieved from the order dated 07.07.2023, is allowed and the order dated 07.07.2023 , is set aside. The Trial Court is directed to consider the application of the appellantcomplainant under Section 156(3) Cr.P.C. afresh after being providing opportunity of hearing to prosecution and complainant.
