The present appeal is preferred by the appellant with a challenge to order dated 21.07.2022, passed by the Court of Additional District Judge, Fatehpur Shekhawati Sikar in Civil Misc. Case No. 35/2018.
The impugned order has been passed by the Court below on an application filed under Order 39 Rule 1 CPC, whereby the TI application was dismissed.
Learned counsel appearing for the respondent submits that original main suit has been dismissed vide judgment and decree dated 30.04.2025, therefore the present appeal has become infructuous.
In view of the fact that original suit itself has been dismissed vide judgment dated 30.4.2025, the present appeal against the order of rejection of TI application is of no consequence and rendered infructuous.
Accordingly, the appeal is dismissed having become infructuous.
