Instant cross objection is pending in S.B. Civil Misc. Appeal No.566/2004, which was disposed of on 24.01.2008 wherein impugned judgment was set aside and the trial Court was directed to decide the lis on the basis of judgment of Hon’ble Division Bench as referred in the order. Since, the order dated 25.02.2004 was set aside and the matter was remitted back, wherein the challenge was only for determination of interim rent.
Having considered aforesaid, this cross objection has rendered infructuous.
Hence, the same is dismissed as rendered infructuous. Misc. application, if any, stands disposed of.
