Heard learned counsel for the parties on the application seeking suspension of sentences (S.B. Criminal Misc. Bail (Suspension of Sentences) No.854/2024).

It is contended by the counsel for the appellant that appellant has been sentenced for ten years R.I. for the offence under Section 8/21 & 29 NDPS Act and fine of Rs.1,00,000/-, in default of payment of fine, he would undergo S.I. for six months. Learned counsel further submits that disposal of the appeal will consume time, therefore, sentences awarded to him may be suspended.

Learned Public Prosecutor has opposed the application for suspension of sentence.

I have considered the arguments advanced by the counsel for the parties and have gone through the material available on record.

Having considered the totality of facts and circumstances and particularly the fact that appellant was on bail during trial and disposal of appeal will consume time, therefore, this Court deems it fit and proper to allow the application for suspension of sentences filed by the appellant.

Accordingly, the application for suspension of sentence filed by the appellant is allowed and it is ordered that the sentence passed by the learned Additional Sessions Judge No.1, Anupgarh District Sriganganagar in Sessions Case No.24/2018 vide judgment dated 1.7.2024 against the appellant Rampratap @ Ramu S/o Thakar Ram shall remain suspended till final disposal of the aforesaid appeal provided he executes a personal bond in the sum of Rs. 1,00,000/- with two sureties of Rs. 50,000/- each to the satisfaction of the learned trial Judge for his appearance in this Court on 23.9.2024 and whenever ordered to do so.
